The managing director of a metalwork firm has been sentenced for manslaughter after one of his workers was crushed to death.

Mohammad Babamiri, of Poplar Grove, Bounds Green, was also found guilty of breaching health and safety laws and given an 18-month suspended sentence after driving a forklift truck without a licence during the incident.

On Friday January 11, 2013 Babamiri’s company RK Metalworks on the Hastingwood Trading Estate, Harbut Road, Edmonton was moving to a smaller unit.

Husband and father of two Shenol Shevka-Ahmed was helping to move a large metal cutting machine which tipped over, trapping him underneath.

Babamiri admitted driving the forklift without a licence while trying to move the machine and was arrested at the scene.

The police, London Ambulance Service, London Air Ambulance and London Fire Brigade all attended the incident.

A car jack was used to free Mr Shevka-Ahmed, who was treated at the scene and then taken to the Royal London Hospital, where he later died.

David Hawkins of Little Brays, Harlow who worked for Hastingwood Trading Estate and was assisting RK Metalworks’ move was filmed on CCTV driving a forklift to help move the machinery.

He had left the scene by the time the police and the Health and Safety Executive arrived to conduct an investigation but was arrested the following morning after being found.

Hawkins was acquitted of manslaughter but found guilty of health and safety offences and received a six-month suspended sentence.

Investigating officer Detective Chief Inspector Dave Whellams said: "This is a tragic case. If the management that employed him had followed simple guidelines and used some common sense, then this incident would never have arisen. The accident itself was totally avoidable and has cost a man his life.”

RK Metalworks was fined a total of £150,000.

Hastingwood Securities Limited, which owns Hastingwood Trading Estate, was also found guilty of breaching health and safety legislation although sentencing was adjourned to a later date.
