AN APPLICATION for a Judicial Review against the Home Secretary's decision to extradite hacker Gary McKinnon has been submitted by his lawyers today.
Last week, Home Secretary Alan Johnson said medical evidence relating to Mr McKinnon's Asperger's syndrome, a form of autism, was not strong enough to halt the move on human rights grounds and his departure to the US was scheduled for today.
Mr McKinnon, 43, of Palmers Green, is facing 60 years in prison if convicted of breaking into top US military computers.
The former Haringey schoolboy, who lived in Crouch End when he committed the offences, has admitted breaching the systems but said he was simply seeking UFO evidence.
The application submitted by Mr McKinnon's legal team includes all previous medical reports with an up to date psychiatric report on Gary's mental well-being.
It also contains two reports, one English and one American, commenting on the assurances which have been provided on behalf of the US Government to accommodate Gary's illness.
His lawyer Karen Todner said: "We hope that on receipt of these documents the Home Secretary may reflect and reconsider his position".
